Terms of Service
These terms of service apply to the services provided by FinlandHosting. By ordering or using a service, the customer accepts these terms and any service-specific terms.
The customer's rights under mandatory legislation always take precedence over these terms.
1. Parties and services
Service provider: Teemu Neittamo / FinlandHosting Sole trader Business ID: 3547928-5
Email: [email protected] Phone: +358 40 151 7757
FinlandHosting is the name and brand the service provider uses for their services.
The customer is a natural or legal person who orders or uses a FinlandHosting service.
A minor may order a service only with the consent of a guardian or other legal representative required to enter into the contract, or if they are otherwise entitled by law to enter into that contract.
FinlandHosting's services include, for example:
- VPS servers
- game servers
- web hosting
- dedicated servers
- domain names
- Discord bot hosting
- other hosting and infrastructure services
- additional services relating to these services.
The specific content, technical features, resources, price and billing period of a service are determined by the order, service description and any service-specific terms.
2. Placing an order and activating a service
The customer must provide accurate, sufficient and up-to-date information when placing an order.
FinlandHosting may review an order before activating the service, for example to prevent fraud, misuse, payment fraud or security risks.
FinlandHosting may request additional information or identity verification from the customer before activating the service.
The service is activated as soon as possible after payment and any required checks.
A delivery time stated on the website, in an order confirmation or by customer service is generally an estimate, unless a specific delivery time has been separately agreed as binding.
The billing period generally begins when the service is activated or made available to the customer, unless otherwise stated when ordering or in a separate agreement.
If delivery of the service is delayed for a reason attributable to FinlandHosting, a consumer customer has the rights provided by applicable legislation.
3. Identity verification and KYC
FinlandHosting may require verification of the customer's identity or order information, for example:
- because of an unusually high risk of fraud or misuse
- in connection with multiple customer accounts or orders
- because of unclear or conflicting customer information
- because of suspected payment fraud
- to ensure the security of the service or infrastructure
- to investigate a history of abuse or misuse
- where FinlandHosting has another justified reason to verify the person placing the order.
An external KYC service provider may be used for electronic identity verification.
If the customer does not wish to participate in biometric verification, FinlandHosting may, where necessary, offer another reasonable and reliable method of identity verification.
If the customer's identity cannot be reliably verified in a situation where verification is reasonably necessary to provide the service securely, FinlandHosting may refuse to activate the service or restrict its use.
If a paid service is not activated at all for this reason, the payment made for that service is generally refunded to the customer, unless there is a reason to retain the payment under the law or another valid contractual basis.
The processing of personal data and KYC data is described in more detail in FinlandHosting's privacy policy.
4. Use of the service
The customer is responsible for the lawful and appropriate use of their service and for the activities of its users to the extent that those activities fall within the customer's responsibility.
The following activities are prohibited in the service, for example:
- unlawful activity
- using the service for criminal activity
- distributing or hosting malware
- phishing or other fraudulent activity
- spam and unauthorised mass messaging
- DDoS attacks and other network attacks
- unauthorised port scanning of other systems
- unauthorised exploitation of vulnerabilities
- disrupting other systems, networks or users
- unauthorised distribution of material that infringes copyright or other rights
- processing stolen credentials, personal data or other unlawfully obtained material
- using the service to harm the network, services or reputation of FinlandHosting or a third party
- cryptocurrency mining and similar exceptionally heavy computation in shared services without FinlandHosting's separate written permission.
On game servers, including FiveM/FX servers, the customer must ensure that the content, files, add-ons and software used have been obtained lawfully and that the customer has the right to use them.
The customer is responsible for content they install, store or transmit through their service.
If the customer's activities cause actual harm to FinlandHosting, such as an IP address being blocked, damage to network reputation, additional operator or service provider costs, action by authorities or abuse-related action, or other financial damage, the customer may be required to compensate for the damage they cause in accordance with applicable law.
5. Resource usage
In shared services, the server's CPU, memory, disk, network and other resources may be shared between multiple customers, unless the service description expressly states otherwise.
The resources stated in the service description describe the resources available to the customer during normal use of the service.
The customer must not use the resources of a shared service in a way that continuously or significantly disrupts other customers' services or compromises the stability of the server platform.
In such a situation, FinlandHosting may temporarily restrict the service's resource usage to the extent necessary to protect the operation of the platform and other customers' services.
In such a situation, FinlandHosting aims to contact the customer before imposing a permanent restriction or terminating the service, unless immediate action is necessary because of a technical, security or misuse risk.
Any service-specific resource limits are stated in the service description or when ordering.
6. Network misuse, DDoS and abuse reports
FinlandHosting may take immediate technical action if traffic directed at or originating from a service causes significant harm or risk to FinlandHosting's infrastructure, service providers, IP addresses or other customers.
Depending on the situation, such measures may include, for example:
- restricting traffic
- blocking a particular port or type of traffic
- temporarily blocking routing to an IP address, known as a null-route
- temporarily restricting the service's network connection
- temporarily suspending the service.
FinlandHosting aims to limit these measures to what is reasonably necessary to manage the situation.
FinlandHosting may investigate justified abuse reports relating to a service and request an explanation from the customer.
The customer must respond within a reasonable time to a justified request for information about abuse or security sent by FinlandHosting.
7. Suspension of the service
FinlandHosting may suspend or restrict use of the service if:
- the customer breaches these terms
- the service is used unlawfully
- the service is used for harmful or fraudulent activity
- the service poses a significant security or misuse risk
- the service compromises the operation of the network, server platform or other customers' services
- material information provided by the customer is inaccurate or misleading
- the customer does not respond within a reasonable time to a justified request for information about misuse or security
- the customer's identity cannot be sufficiently verified in a risk situation where verification is required
- the service fee remains unpaid.
In serious or urgent situations, the service may be suspended immediately without prior notice.
In other situations, FinlandHosting aims to give the customer a reasonable opportunity to remedy the breach before permanently terminating the service.
FinlandHosting may remove or block access to content that is unlawful or breaches these terms where necessary because of the law, a requirement from an authority or service provider, or the security of the service.
8. Payments and billing
Services are paid for in advance according to the billing period selected when ordering.
The price of the service is determined by the price list in force at the time of ordering or by an offer made separately to the customer.
For an ongoing service, FinlandHosting bills the next billing period in accordance with the agreement in force, unless the customer terminates the service before the next billing period begins.
FinlandHosting may suspend the service if payment is overdue.
If payment is not made within a reasonable time despite a reminder, FinlandHosting may terminate the service and delete the associated service data.
The customer must ensure that their data is backed up before the service ends.
Late payment may incur interest in accordance with the Interest Act and reasonable collection costs permitted by applicable legislation.
A new consumer customer's 14-day right of withdrawal and refund is set out in section 14 of these terms.
After this period, service fees paid for service time already used are generally not refunded, unless the customer is entitled to a refund under the law, because of a defect in the service, under these terms or service-specific terms, or under a separate agreement.
9. Price changes
FinlandHosting may change the prices of open-ended services for the following justified reasons:
- a significant change in the costs of producing or procuring the service
- changes in data centre, energy, network, IP address, licence or hardware costs
- changes in taxes or other public charges
- changes in legislation or requirements imposed by authorities
- changes in the technical implementation of the service that affect the costs of providing it.
The price change must be proportionate to its basis, and this clause alone does not permit a material change to the substance of the contract from the consumer's perspective.
A consumer customer is clearly notified of a price change in advance. The notice states the new price, when the change takes effect and the reason for the change.
A price change that imposes additional obligations on a consumer generally takes effect no earlier than 30 days after notification, unless it results from a change in legislation or a decision by an authority that requires a different date.
The consumer may terminate their open-ended service before the change takes effect.
The price of a billing period that has already been paid for is not changed retrospectively.
The price of a fixed-term consumer contract is generally not changed during the agreed term. A change may be made only where it is based, for example, on a change in legislation or a decision by an authority that could not have been taken into account when entering into the contract, or where mandatory legislation otherwise permits the change.
10. Backups and customer data
The customer is responsible for appropriate backups of their own data and content, unless the service description expressly provides for a backup service for which FinlandHosting is responsible.
FinlandHosting may provide automatic backups as part of a service or as a separate additional service.
Backups provided by FinlandHosting do not remove the customer's obligation to keep an independent backup of important data where such precautions are reasonably possible.
FinlandHosting does not guarantee the availability, integrity or recoverability of an individual backup unless such a guarantee is expressly given in the service description or a separate agreement.
This section does not limit the customer's rights under mandatory legislation.
11. Intellectual property rights
Intellectual property rights relating to the customer's own content remain with the customer or the original rights holder.
FinlandHosting holds the intellectual property rights relating to its website, its own software, materials, trademarks and other material produced by FinlandHosting itself.
Rights to third-party software, control panels and other components belong to their respective rights holders.
The customer must not copy, modify, distribute or resell protected material belonging to FinlandHosting or a third party without the appropriate rights.
12. Service availability, maintenance and disruptions
FinlandHosting aims to keep its services available and operational.
Unless a service level or SLA has been separately agreed for the service, FinlandHosting does not guarantee completely uninterrupted availability.
The service may experience interruptions due to, for example:
- scheduled maintenance
- urgent security updates
- hardware failures
- software failures
- network disruptions
- DDoS attacks
- data centre or operator disruptions
- force majeure
- other events beyond FinlandHosting's reasonable control.
FinlandHosting aims to give advance notice of significant scheduled maintenance where reasonably possible.
Credits relating to a separately agreed SLA are determined by that SLA or the service agreement.
This section does not limit a consumer customer's rights under mandatory legislation in the event of a defect in the service.
13. Limitation of liability
FinlandHosting is not liable for consequential or indirect damage, such as lost revenue, profit or business opportunities, or indirect damage suffered by a third party, to the extent that such a limitation of liability is permitted by law.
For a business customer, FinlandHosting's total liability relating to a single service is generally limited to the amount the customer paid for that service during the three months preceding the event causing the damage, unless otherwise agreed in writing.
The three-month liability limit above does not apply to a consumer to the extent that it would restrict their rights under mandatory legislation.
FinlandHosting is not liable for damage caused by the customer's own actions, errors in applications or software maintained by the customer, incorrect settings made by the customer or changes carried out by the customer, to the extent that the damage does not result from a defect for which FinlandHosting is responsible.
Limitations of liability do not apply to damage to the extent that liability cannot be limited or excluded under applicable law.
14. Consumer's 14-day right of withdrawal and refund
A consumer customer has a right of withdrawal in distance sales under applicable consumer protection legislation.
FinlandHosting offers a consumer customer the opportunity to withdraw from a new service order within 14 days of entering into the contract and receive a full refund of the service fee paid for that service, even if the service has already been activated and its delivery has begun.
The customer must clearly notify FinlandHosting of the withdrawal within 14 days of entering into the contract, for example through customer service or by email to [email protected].
The customer does not need to give a specific reason for withdrawing.
The service may be closed after the withdrawal notice is received. Before withdrawing, the customer must ensure that their data in the service is transferred and backed up.
FinlandHosting's voluntary refund policy in this section, which goes beyond statutory rights, may be restricted in cases of obvious misuse, such as where:
- the service has been used for unlawful activity
- the service has been used for fraud
- the service has been used to send spam
- the service has been used for network attacks
- the customer has materially breached these terms
- the same customer repeatedly attempts to take advantage of the voluntary refund policy to obtain services effectively free of charge.
Such a restriction applies only to FinlandHosting's voluntary refund policy and does not limit the customer's rights under mandatory consumer protection legislation.
A refund is generally made using the same payment method the customer used for the original payment, unless otherwise agreed separately with the customer.
15. Duration and termination of the contract
The service may be open-ended or fixed-term, as stated when ordering.
The length of the billing period alone does not make the contract fixed-term, unless the service is expressly stated to be fixed-term when ordering.
The customer may terminate an open-ended service through the control panel or by contacting FinlandHosting's customer service.
Termination prevents a new billing period from beginning where the request is made before the next billing period begins and sufficiently early for the request to be processed normally.
The service generally remains available until the end of the billing period already paid for, unless the customer requests immediate termination or there is another basis for suspending the service.
A fixed-term service ends at the end of the agreed term or continues in the manner expressly stated in the order.
FinlandHosting may terminate a service immediately because of a serious breach of these terms, unlawful activity, fraud, unpaid invoices or a significant security or misuse risk.
In a situation that is not urgent, FinlandHosting aims to give the customer a reasonable opportunity to remedy the breach of contract before permanently terminating the service.
16. Deletion of data when the service ends
When the service ends, the customer must ensure that their data and backups in the service are transferred before the service is deleted.
Customer content stored in the service may be deleted after the service ends.
FinlandHosting does not guarantee retention or recoverability of the content of an ended service after it ends, unless otherwise agreed separately.
Data in a service suspended because of non-payment or a breach of these terms may be deleted after the service is terminated.
Personal data that must be retained by law or on another valid legal basis may be retained after the service ends in accordance with FinlandHosting's privacy policy.
17. Consumer's statutory rights
If the customer acts as a consumer, the mandatory provisions of Finland's Consumer Protection Act apply to the service.
These terms do not limit the consumer's rights under the law.
In the event of a defect in or delay of the service, a consumer may, under applicable legislation, have the right, for example, to:
- require the defect to be remedied
- withhold payment to the extent permitted by law
- receive a price reduction
- terminate the contract
- receive compensation for damage.
The conditions for exercising these rights are determined by applicable consumer protection legislation.
18. Changes to the terms of service
FinlandHosting may change the terms that apply to an open-ended service for the following justified reasons:
- changes in legislation
- changes in a requirement or decision imposed by an authority
- a significant change in the technical implementation of the service
- improving the security of the service
- preventing new misuse or security risks
- a significant change in the costs of producing, procuring or otherwise providing the service
- changes to the features of the service that do not materially change the substance of the contract from the customer's perspective.
The change must be justified and proportionate to its basis.
The customer is clearly notified in advance of a material change affecting their position.
The notice states the content of the change, when it takes effect and the reason for it.
A change that imposes additional obligations on a consumer generally takes effect no earlier than 30 days after notification, unless it results from a change in legislation or a decision by an authority that requires otherwise.
If a consumer does not accept a material change to an open-ended service, they may terminate the service before the change takes effect.
The terms of a fixed-term consumer contract are generally not changed to the consumer's detriment during the agreed term. A change may be made only on a basis permitted by law.
19. Applicable law and dispute resolution
These terms are governed by Finnish law.
Any disagreements are primarily addressed through negotiation between the customer and FinlandHosting.
Where necessary, a consumer may contact Consumer Advisory Services.
If a disagreement cannot be resolved through negotiation or with the help of Consumer Advisory Services, the consumer may refer the matter to the Consumer Disputes Board.
The consumer may also refer the matter to a court with jurisdiction under the law.
These terms do not limit the consumer's right to bring an action in a court with jurisdiction based on their place of residence where the law provides that right.
Disputes with business customers are resolved by a competent general court in Finland, unless otherwise agreed in writing between the parties.
20. Data protection
FinlandHosting processes personal data in accordance with applicable data protection legislation and FinlandHosting's privacy policy.
The privacy policy describes, in more detail, matters including:
- the personal data processed
- the purposes and legal bases for processing
- identity verification
- KYC identity verification
- processing of biometric data
- data retention periods
- rights of the data subject.
